Rental Agreement

This Photobooth Rental Agreement ("Agreement") is made and entered into on [Date], by and between Somethin' Borrowed, ltd ("Provider") and [Client's Name] ("Client").

1. Services Provided Provider agrees to provide a photobooth rental for the event described below:

  • Event Date: [Event Date]
  • Event Location: [Event Location]
  • Event Duration: [Number of hours] Hours beginning at [Start Time]

2. Payment Terms

  • Total Rental Fee: $[Total Amount]
  • Deposit: $[Deposit Amount] (due upon signing this Agreement)
  • Balance: $[Balance Amount] (due 2 weeks before the event date)

3. Cancellation Policy

  • Cancellations made 30 days before the event will receive a full refund of the deposit.
  • Cancellations made less than 30 days before the event will forfeit the deposit.
  • Should the need to reschedule occur, and there are no conflicts on the part of the Provider, no penalty will be incurred. If Provider is unable to accommodate the reschedule date and it is less than 30 days to originally booked date, it will be considered a cancellation resulting in forfeiture of deposit.

4. Responsibilities of the Provider

  • Set up the photobooth at least 30 minutes before contracted start and take it down within 30 minutes of contracted end.
  • Provide an attendant to operate the photobooth during scheduled time.
  • Supply all necessary equipment and props, including but not limited to lights, signage, printer and backdrop is applicable.  

5. Responsibilities of the Client

  • Ensure access to the event location for setup and takedown.
  • Provide parking in close proximity to the access door to be used for unloading and loading equipment. Distance is not to exceed 100 yards.  
  • Provide a suitable location of no less than an 8 (wide) x 8 (deep) x 8 (tall) foot space for the effective operation of the photobooth.
  • Provide access to a power outlet either by extension cord or wall outlet at the designated location of photobooth. If one can not be provided, such as the event is held outside, the Client is to communicate in writing to the Provider so that accommodations can be made.
  • Ensure the safety and security of the photobooth equipment during the event.
  • Any changes to event location are to be communicated in writing to the Provider 2 days prior to event. 

6. Permission to Use Photos and Videos:

  • By signing this contract, the Client grants Somethin' Borrowed, ltd the right to use any photos or videos taken during the event for promotional purposes, including but not limited to social media, website, and marketing materials.
  • The Provider will make reasonable efforts to exclude any guests who have not consented to be photographed from promotional materials.
  • The right to use photos and videos for promotional purposes is granted for a period of 5 years from the event date.

7. Client's Social Media Use:

  • The Client is encouraged to share photos and videos from the event on their personal social media accounts. When doing so, the Client agrees to credit Somethin' Borrowed, ltd by tagging our official social media handles and using the designated event hashtag that will be determined prior to the event. 

8. Privacy and Consent:

  • The Client is responsible for ensuring that all guests at the event are aware that their photos and videos may be used for promotional purposes.
  • The Provider will make reasonable efforts to exclude any guests who have not consented to be photographed from promotional materials.

9. Content Restrictions:

  • The Client agrees not to post any photos or videos that the Provider deems inappropriate, offensive, or harmful to the reputation of Somethin' Borrowed, ltd.
  • The Provider reserves the right to request the removal of any such content.

10. Damages

  • Client agrees to be responsible for any damage to the photobooth or its equipment caused by the Client or event attendees. In the event of damage, the Client will be liable for the cost of repairs or replacement of the damaged equipment.
  • The Provider will assess the damage and provide an invoice for the repair or replacement costs in good faith, which the Client agrees to pay within 14 days of receipt.

11. Liability

  • Provider is not responsible for any injuries or damages that occur during the use of the photobooth. Client agrees to indemnify and hold harmless the Provider from any claims arising from the event.
  • The Provider carries liability insurance as required by Nebraska State law.

12. Governing Law

  • Any legal disputes arising from this Agreement shall be resolved in the courts of Madison County, Nebraska.

13. Entire Agreement

  • This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.
  • Any amendments to this Agreement must be made in writing and signed by both parties
